(1) The Plaintiff added the Plaintiff’s claim for the return of investment money under the agreement on return of investment money to the Defendant as a preliminary claim. However, as seen below, it is not necessary to determine the conjunctive claim since the Defendant deemed the facts constituting the Plaintiff’s primary claim to have led to a confession as seen in paragraph (2). 2. The Defendant does not dispute the Plaintiff’s assertion as to the grounds of claim because the Defendant did not give any reply despite being served with the instant complaint, and does not appear on the date of pleading even after being notified of the date of pleading. Thus, the Plaintiff is deemed to have led to the confession of the facts alleged in the Plaintiff’s separate claim pursuant to Article 150(3) and (1) of the Civil Procedure Act (a).
