2. The costs of lawsuit shall be borne by the Plaintiff.

A. On October 9, 2013, the Plaintiff filed an application for refugee status with the Defendant on October 22, 2013, when entering and staying in the Republic of Korea on a short-term visit (C-3) sojourn status as of October 9, 2013, which was prior to the expiration date of the period of stay ( October 24, 2013).

B. On September 11, 2014, the Defendant rendered a decision to deny refugee status (hereinafter “instant disposition”) on the ground that the Plaintiff does not constitute a case where there is a well-founded fear that the Plaintiff would be subject to persecution” as prescribed by Article 1 of the Convention on the Status of Refugees and Article 1 of the Protocol Relating to the Status of Refugees.

2. Whether the instant disposition is lawful

A. The Plaintiff’s assertion error was a dispute over the land from around 1986 to Egu-gu village, a neighboring village, and Egu-gu village, and the Plaintiff’s claim error, but the land owned by the village was insignificant and beautiful, and the Egu-gu village attempted to make the land as its own land.
