1. The Defendant: (a) KRW 215,80,000 for the Plaintiff and KRW 20% per annum from August 8, 2015 to September 30, 2015; and (b) the Plaintiff.
The facts without dispute. According to the purport of Gap evidence No. 1 and the arguments, the plaintiff, on December 27, 2012, transferred US dollars 200,00 to the account of Donian Company C located in Donian as designated by the defendant, but did not receive long language. The defendant on November 2, 2013, "if the plaintiff is unable to recover cash or cash from C until June 2014, the plaintiff is liable to provide cash (1079 won/$215,800,000) or goods during July 2014, the defendant prepared an agreement with the purport that "the plaintiff will provide cash (1079 won/$215,800,000 at the time of exchange rate) or goods to the defendant during the period of 205.15% of the annual interest rate from the next day to the day of 2005.5% of the plaintiff's annual interest rate of 2015.15% of the plaintiff's annual interest rate of this case.
Therefore, the plaintiff's claim is justified within the above scope of recognition, and the remainder is dismissed as it is without merit. It is so decided as per Disposition.
