A. The Plaintiff is an individual entrepreneur who manufactures and sells garbage pulverization machine in the trade name of “B,” and the Defendant is a corporation that manufactures and sells small electric motors.

B. On November 201, 201, the Plaintiff entered into a contract with Samjin Co., Ltd. (hereinafter “Tjin”) for the supply of the motherer for the production of food pulvers to KRW 47,00 per 1 unit, and around that time, the Plaintiff entered into a contract for the production and supply of the motherer in accordance with the Plaintiff’s development request from the Defendant for the foregoing reasons.

C. Accordingly, from November 201 to July 2013, 2013, the Defendant supplied the Plaintiff a model name SD20-200G (OG87), 3,906, model name SD120-220G (OG88), 1,515, and model name SD150-220G (OH68) master from April 201 to October 2013 (OH68), 6,01, and 1,00 master name S9D150-220G (OH94) master name from October 201, 201 to July 2013 (hereinafter each “O87 mother, OG88, O68, Ma684, Ma694,” and the Plaintiff supplied the same in total.

The Plaintiff manufactured a garbage crushing machine for kitchen use as the mother of this case (hereinafter referred to as “food crushing machine of this case”) and sold it to consumers.

E. On September 25, 2013, the Plaintiff demanded Samjin-ro to prepare a solution for the problems, such as return and refund of the food crushing machine of this case, and compensation for damages, due to the defect in the mother of this case.

F. After investigating the Plaintiff’s inferior phenomenon, on November 29, 2013, the Defendant analyzed that the cause of the inferior phenomenon of the mother was due to the increase in the capacity of the electric current breaker used for the finished product of the food crushing machine, and submitted to the Plaintiff a report on the “Cditer’s analysis of the defective condition and the review of the improvement plan” by reviewing the improvement plan accordingly.
