1. The Defendant: (a) KRW 100 million and the Plaintiff’s KRW 5% per annum from June 15, 2016 to April 20, 2017, and the next day.

Reasons

Comprehensively taking account of the entries in the evidence No. 1 and the purport of the entire pleadings, the Plaintiff had a loan claim of KRW 100 million against the Plaintiff. The Defendant, on March 3, 2015, is obligated to pay the Plaintiff KRW 100 million by the annual rate of 15% per annum as stipulated in the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings, on behalf of the Plaintiff, to pay KRW 100 million to the Plaintiff by June 14, 2016. Thus, the Defendant is obligated to pay the Plaintiff damages for delay calculated by the annual rate of KRW 100 million and the annual rate of KRW 15% per annum as stipulated in the aforesaid written statement of payment, pursuant to the agreement, from June 15, 2016 to April 20, 2017, on which the original copy of the payment order was served to the Defendant from June 15, 2016 to the date following the date of payment.
