The defendant shall pay 130,00,000 won to the plaintiff and 12% per annum from September 1, 2017 to the day of complete payment.
1. The Plaintiff, on June 20, 201, lent KRW 130,00,00 to C Co., Ltd. on June 20, 2017 with a maturity of KRW 27.9% per annum on August 30, 2017, and the Defendant guaranteed the obligation of the above loan by the overdue interest rate of KRW 130,00,000, and the Defendant is liable to pay as the guarantor of C Co., Ltd. the amount of KRW 130,000,000 and damages for delay calculated at the rate of 12% per annum as requested by the Plaintiff from September 1, 2017 to the date of full payment.
In regard to this, the defendant borrowed KRW 100 million and claimed that the above loan was partially repaid, but there is no evidence to acknowledge this, and the defendant's above assertion is without merit.
2. It is so decided as per Disposition by the assent of all participating Justices, on the ground that the plaintiff's claim of this case is reasonable.
