1. Basic facts
A. On February 18, 2013, the Plaintiff film ready-mixed Co., Ltd. (hereinafter “Plaintiff film ready-mixed”) completed the registration of ownership transfer on the size of 1202-1 miscellaneous land in Seocheon-gu, Seocheon-si, Sejong-si, and 341 square meters in the same Ri 1399-282 square meters in the same miscellaneous land.
B. On February 18, 2013, Plaintiff New Co., Ltd. (hereinafter “Plaintiff New Co., Ltd.”) completed the registration of transfer of ownership with respect to the land of 1192 square meters in Seocheon-gu, Incheon-si, Incheon-do, 1200-4 miscellaneous land of 507 square meters in the same Ri, 1200-5 miscellaneous land of 900 square meters in the same Ri, 199 square meters in the same Ri 1200-7 miscellaneous land of 1200-7 199 square meters in the same Ri, 1200-8 miscellaneous land of 1201, 870 square meters in the same Ri, 1201-2 miscellaneous land of 90 square meters in the same Ri, 1202 miscellaneous land of 135 square meters in the same Ri, 139-28 miscellaneous land of 2026 square meters in the same Ri.
C. On June 14, 2012, the Defendant purchased the real estate indicated in the Daegu District Court’s 2092m2, D 377m2, E prior 825m2, F208m2, and the attached list in the auction procedure for the voluntary auction procedure for the Daegu District Court racing support B. D.
On the ground of the 1399-282 on the Yancheon-si, Seocheon-si, Incheon, there is a factory owned by the Plaintiff, the factory owned by the Plaintiff, the same Ri 1197, the same Ri 1201, and the same Ri 1399-283, and the factory owned by the Plaintiff, the Plaintiff, the 1209-1 road 199 square meters in the same Ri, the 1205-4 miscellaneous land owned by the Plaintiff, the 6 square meters in the same Ri 1202-1 341 square meters in the same Ri, the 1202-1 miscellaneous land in the same Ri, the 103 square meters in the same Ri 120-8 miscellaneous land owned by the Plaintiff, and the 1200-4 miscellaneous land in the same Ri 120-4 507 square meters in the same Ri 1201-2 miscellaneous land.

2. Determination on this safety defense
A. (i) The Plaintiffs do not possess or use the adjoining land of the real estate listed in the separate sheet, and thus are not eligible to the Plaintiff in the instant lawsuit.
The plaintiffs are not operating Lemi-concil companies on the adjoining land of the real estate listed in the attached list.
