1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by each person;

Reasons

1. The following facts leading to the instant dispute are either not disputed between the parties, or may be acknowledged by adding the whole purport of the pleadings to the entries in the evidence Nos. 1 and 2.

Since 1975, C, as the Plaintiff’s spouse, leased and cultivated the land of Jeonnam-gun D and E (hereinafter “instant land”) from F, the Defendant’s spouse.

After the death of C, the Plaintiff succeeded to the status of the tenant of C, and the Defendant succeeded to the status of the lessor after the death of F, and the Plaintiff and the Defendant continued to renew the said lease agreement.

B. Meanwhile, under the above lease agreement, C and the Plaintiff installed and managed salt farm facilities, including salt warehouses and salt boards, on the instant land (hereinafter “instant ground facilities”), and cultivated salt farms.

C. The Plaintiff and the Defendant concluded a lease contract with the term of lease on February 11, 2012 from February 11, 2012 to December 31, 2012, when the lease contract was renewed and entered into.

On December 31, 2012, when the above lease contract expires, the Defendant notified the Plaintiff that no purport exists to renew the lease contract. On January 1, 2013, the Plaintiff handed over salt farm facilities, such as salt warehouses and salt boards, to the Defendant around January 1, 2013.

2. The parties' assertion

A. The Plaintiff, as a lessee of a lease agreement on the land of this case for the purpose of owning the land of this case, requested the Defendant to purchase the land of this case.

The appropriate price of the instant ground property is KRW 70,000,000.

The Defendant is obligated to pay the Plaintiff KRW 70,000,000 for the purchase price for the instant ground property.

B. The Plaintiff agreed to assign the instant ground water to the Defendant and to waive the right to purchase the ground water.

The plaintiff used the land of this case in comparison with other salt sources in the vicinity. The plaintiff used the land of this case, and has several obligations under the lease contract.
