Punishment of the crime
1. The Defendant in violation of the Road Traffic Act is a person engaged in driving a B-wing and third freight vehicle.
On December 20, 2019, at around 13:50 on December 20, 2019, the Defendant driven the above vehicle in a parking condition at the front of the Kimpo-si, and proceeded to the front of the parking lot.
In such cases, a person engaged in driving of a motor vehicle shall accurately operate the steering wheel, brakes and other devices of the motor vehicle, shall not drive the motor vehicle at a speed or in such a manner as to inflict any danger and injury on others according to the traffic conditions of the road and the structure and performance of the motor vehicle, and has a duty of care to ensure that he/she is able to safely report the traffic situation on the front
Nevertheless, the Defendant neglected to do so and proceeded on the right side of the Defendant’s driving vehicle, which is parked on the right side of the Defendant’s driving vehicle, and conflicts over the top side of the Defendant’s driving vehicle.
Ultimately, the Defendant damaged the above damaged vehicle’s estimated repair amounting to KRW 1,253,921 by negligence in the course of business as above.
2. The Defendant in violation of the Guarantee of Automobile Accident Compensation Act is a person who owns and drives B-wing three cargo vehicles.
No person who owns a motor vehicle shall operate any motor vehicle on the road which is not covered by mandatory insurance.
Nevertheless, at around 13:50 on December 20, 2019, the Defendant driven the above vehicle, which was not covered by mandatory insurance in approximately 1km section from the front parking lot in the city of Kimpo-si to return from the front road in the same city F.
