1. The Defendant (Counterclaim Plaintiff) among the judgment of the first instance, including the Defendant (Counterclaim Plaintiff) Plaintiff’s counterclaim claim expanded by this court.
1. Basic facts
A. Two enforcement officers work for the Daegu District Court D Branch D branch (hereinafter “D branch”). From July 1, 2012 to December 31, 2015, E works for the Plaintiff from August 25, 2012 to August 24, 2016, and Defendant B as the enforcement officer for D branch, respectively, from January 1, 2016 to December 31, 2017, and Defendant C served as D branch officer for D branch from August 25, 2016 to December 31, 2017.
B. The main contents of the Enforcement Act and the Enforcement Rules relating to the instant case are as follows:
The chief of a district court shall appoint enforcement officers under Article 3 (Appointment) of the Enforcement Decree Act from among those who have served as Grade VII court clerks, Grade VII registration officials, Grade VII prosecution officials, Grade VII narcotics investigation officials or higher for at least ten years.
Article 7 (Supervisory Body) (1) Execution officers shall be supervised by the chief of the district court to which they belong.
Article 8 (Office) (1) Execution officers shall establish an office in a place designated by the chief of the district court or the branch court within the jurisdiction of the district court to which they belong.
(2) The office of enforcement officers shall have a representative enforcement officer.
(3) The representative execution officer under paragraph (2) shall represent the execution officers belonging to the office of execution officers and exercise general control over the affairs concerning the operation thereof.
(4) The office of enforcement officers may employ clerical staff.
(5) Matters concerning the number of and qualifications for clerical staff members and performing their duties under paragraph (4) shall be prescribed by the Supreme Court Regulations.
Article 20 (Operation of Office) (1) Enforcement officers shall establish rules on the operation of offices and obtain permission from the chief of the district court to which they belong.
The same shall apply to the modification of the regulations.
(2) Execution officers may form a joint office of enforcement officers among the affiliated offices of enforcement officers of the said district court with permission from the president of the said district court.
(3) The rules under paragraph (1) shall include the following matters:
1. Name and location;
2. Matters concerning members;
3. Matters concerning executives, such as representative execution officers;
4. Matters concerning the apportionment of affairs; and
5. Matters concerning revenue and expenditure distribution;
6. The fixed number, remuneration, raise in salary of clerical officials;
