1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. Basic facts

A. On April 27, 2016, the Plaintiff entered into a contract on the management of the building (hereinafter “instant contract”) with the Defendant and four other (C, D, E, and F) (hereinafter “instant building”) on the building (around 20% out of the nine 110 stores of the instant building at the time of sale) and the main contents and additives thereof are as follows.

Article 2. Labeling of the subject of management

3. Management area: Article 3 (Management Period) of the area of 14,11.90§³ (4,268.83 square meters).

1. The term of this contract shall be one year from May 3, 2016 to April 30, 2017;

Article 4 (Contract Method and Amount) 1.B (Plaintiffs, hereinafter the same shall apply) The amount of a contract for building management shall be as follows:

Amount of contract: Affairs of management of Article 6,610,000 won per month (Separately 6,000 won per square);

1. All maintenance and management of the section for common use of the building, facilities annexed to the building, and machinery and equipment;

2. Cleaning of buildings, removal of wastes, parking management, and water supply;

4. Article 7 (Organization of Management Personnel) to urge the imposition, receipt, and attempted management expenses.

1. The composition of the management staff shall be the chief of the management office, U.S. dollars and parking;

Article 8 (Management Expenses)

1. B shall impose management expenses on his/her behalf in accordance with relevant regulations;

3. Management expenses shall be collected by settling accounts on a monthly basis; and

(1) The administrative costs shall consist of 6,00 won per ordinary day, personnel costs, welfare costs, entrustment fees, various statutory inspection costs, outsourcing management costs, insurance premiums and legal education costs, and shall be fixed and imposed every month.

(2) Various charges and expendable materials necessary for the repair and maintenance of public facilities shall be calculated and imposed on the actual expenses incurred each month.

(3)The amount of household use in public charges, namely electricity and water rates, shall be calculated by measuring instruments, and any non-legal measuring instruments shall be allocated in accordance with the ordinary calculation method applicable to the same industry.

8. The management fees and user fees for the unregistered space shall be borne by the owner in the register of the building and shall be succeeded to by the special successor.
