Punishment of the crime
The Defendant of “2015 Highest 1582” is a person who is engaged in the trade of used home appliances while operating a truck with a phrase “serious, high-priced, computers, monitors, washing machines, air conditioners, or TV inserted.”
The defendant, who is engaged in the sales of used home appliances, has a duty of care to verify the identity of the seller when purchasing the used home appliances, and to verify whether the goods are stolen or not by examining the details of acquisition, motive for sale, and demand for the price suitable for the transaction price, etc.
1. Between September 3, 2014 and April 4, 2014, the Defendant acquired stolen goods due to negligence in the course of business by purchasing KRW 300,000,00 from D’s house located in Asan City, and purchasing from D the amount equivalent to KRW 1-A, the market price of LG CD TV 1 owned by the victim, which was stolen, as described in paragraph 1-A, and failing to verify the identity of D, etc.
2. On September 7, 2014, the Defendant: (a) purchased from D’s house the amount equivalent to KRW 1,00,000 from D; (b) purchased from D the amount equivalent to KRW 1,00,000 from D’s market price; and (b) failed to verify D’s personal information; and (b) obtained the stolen goods by negligence by purchasing the said amount of 10,000,000 won from D’s house.
3. On September 17, 2014, the Defendant: (a) at D’s house around 19:00, and (b) at D’s home, one of D.
As described in paragraph (1), a stolen victim E-kim air conditioning, which purchased an amount equivalent to KRW 100,000 at the market price of 1,00,000 and did not confirm the identity of D, and acquired stolen water by acquiring the stolen water free of charge due to negligence, such as neglecting judgment on the stolen water.
4. On February 6, 2015, the Defendant: D’s house around February 6, 2015; D’s house from D.
The identity of D is a purchase of the amount equivalent to 680,000 won at the market price of LG SP TV owned by the victim G, such as described in the paragraph.
