A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime
On June 18, 2014, the Defendant was sentenced to imprisonment with labor for a violation of the Narcotics Control Act at the Incheon District Court on the grounds of a violation of the Act on the Control of Narcotics, etc., and the execution of the sentence was terminated on April 21, 2015.
Despite the fact that the Defendant is not a narcotics handler, he/she purchased, administered, and possessed the Melopopon (one philopon; hereinafter “philopon”) which is a local mental medicine as follows, and smoked marijuana.

1. Violation of the Narcotics Control Act;
A. On July 2016, the Defendant: (a) purchased 1.6 million won from D at the parking lot for the Seoul building in Nam-gu Incheon Metropolitan City, Nam-gu; and (b) sold 8 grams of phiphonephones.
B. On October 26, 2016, around 03:00, the Defendant administered phiphones by inserting approximately 0.05g phiphones into a single-use injection machine in the Defendant’s residence located in Nam-gu Incheon Metropolitan City, and dilution with water, and administering phiphones in a way of injecting them into the Defendant’s left part of the blood transfusion.

On October 26, 2016, around 13:15, the Defendant: (a) carried eight plastic bags (including 9.8 grams, 6.28g, 9.75g, 9.75g, 9.92g, 10.96g, 10.05g, and 9.74g) in front of the Seoul Southern-gu Incheon Metropolitan City, for sale, using a total of 75.19g of the Philopon in Defendant’s shop, and carrying it in the manner of storing 75.19g of the Phopon in the Genetos of the Defendant’s operation, for the purpose of administering in water in the Gene vehicle located near the same place.
2. On October 26, 2016, the Defendant, in violation of the Narcotics Control Act (marijuana), smoked a marijuana as if he smoked, after deducting the first tobacco of one cigarette from the Defendant’s residence located in the Nam-gu Incheon Metropolitan City, Nam-gu, and 0.2g of the hemp.
