강제추행
The prosecution of this case is dismissed.
1. On January 31, 2013, at around 02:20, the Defendant discovered the victim E (the age 26) returning home on the street in front of Mapo-gu Seoul, Mapo-gu (the age 26), and followed the victim who was entering a alleyway, she saw the victim as his/her hand so that the victim may not be able to sound, and then she committed an indecent act on the victim by making the victim’s hand his/her hand so that the victim may not sound.
2. The above facts charged constitute Article 298 of the Criminal Act, and the prosecution may be instituted only when the victim files a complaint pursuant to Article 306 of the Criminal Act.
On June 14, 2013, the victim submitted a written withdrawal of complaint to this court after filing the instant indictment.
Therefore, the prosecution of this case is dismissed in accordance with Article 327 subparagraph 5 of the Criminal Procedure Act.
