The prosecution of this case is dismissed.
1. On February 21, 2019, from around 05:00 to around 05:10 on the same day, the Defendant: (a) under the influence of alcohol at a “C” restaurant located in Suwon-si B; (b) expressed the victim D (Nam, 21) who, without any other reasons, took a bath as to whether he/she would be “Isle, Isle, Isle”; and (c) assaulted the victim as his/her hand, by sticking the victim’s right shoulder, and again taking the victim’s right shoulder.
2. Determination
(a) Crimes of non-compliance with will: Article 260 (3) of the Criminal Act;
B. After the instant indictment, the victim expressed his/her intent not to have the Defendant punished (the Agreement dated September 7, 2019)
(c) Judgment dismissing public prosecution: Article 327 subparagraph 6 of the Criminal Procedure Act;
