1. The instant lawsuit was concluded on January 10, 2018 as deemed to have been withdrawn from the appeal.
2. After filing an application for designation of the date on January 16, 2018.
1. The following facts are remarkable or obvious in records in this Court:
The judgment of the first instance court of this case was sentenced on May 18, 2017, and the defendant submitted a petition of appeal on June 14, 2017 after being served with the original judgment on June 1, 2017.
B. On July 21, 2017, this Court tried to serve the Defendant with an order to make a tiny, and the above order to make a tiny was not served as an abandoned absence.
Accordingly, on August 7, 2017, this Court served the defendant with the order of preparation for seat by registered mail, and served the defendant on the same day as the order of preparation for seat.
C. On September 6, 2017, the Defendant filed an appellate brief, and this court tried to serve the Defendant a notice of the first date for pleading on October 24, 2017. The said notice of the date for pleading was not served as a closed door absence.
Accordingly, on October 31, 2017, this Court sent a notice of the first date for pleading to the Defendant and sent it to the Defendant on the same day.
The Defendant was absent on the first day for pleading ( November 1, 2017) in the trial of the trial, and the Plaintiff (Appointed Party; hereinafter “Plaintiff”) appeared, but did not present the pleading.
(Non-Appearance of both parties once).
Accordingly, this Court tried to serve a notice of the second date for pleading on November 1, 2017, after re-established the second date for pleading on November 29, 2017 at 11:00, and then to serve the second date for pleading on November 1, 2017. The said notice of the date for pleading was not served as a closed door absence.
Accordingly, on November 15, 2017, this Court sent a notice of the second date for pleading to the Defendant, and sent the notice of the date for pleading to the Defendant on November 16, 2017.
F. The defendant was absent from the court on the second day for pleading, and the plaintiff was present at the court, but did not present his opinion.
(g) On December 4, 2017, the Defendant submitted an application for the designation of the date on which the date was fixed, and this Court, on January 10, 2018, once again set the third date for pleading on October 10, 2018, shall serve a notice of the date for pleading on the third date for pleading.
