On January 12, 2013, the Defendant prepared knife (15cm in blade length, No. 1), knife (Evidence No. 2), knife (Evidence No. 3), knife tape (Evidence No. 4), knife (Evidence No. 5), and knife (Evidence No. 5) at the Defendant’s residence located in Yacheon-gun, Yacheon-gun, Yacheon-gun, in order to take the property of others, and moved approximately 15cm away from the Defendant’s residence.

피고인은 같은 날 18:50경 위 E에 있는 피해자 F(48세)의 거주지 인근에 이르러 그곳까지 타고 간 오토바이를 세워두고 미리 준비한 위 복면ㆍ목장갑을 착용한 후 피해자의 거주지까지 걸어간 다음 창문을 열고 방안으로 들어가 방문 뒤에서 기다리던 중 마침 샤워를 마치고 방으로 들어오는 피해자의 옆구리 부위에 위 칼을 들이대고 피해자에게 "꼼짝 마, 움직이면 죽인다."라고 말하여 피해자가 반항하지 못하게 한 후 피해자로부터 금원 등의 재물을 강취하려고 하였으나 피해자가 반항하는 바람에 미수에 그치고, 그 과정에서 칼로 피해자의 손 부위를 베이도록 하여 피해자로 하여금 약 3주간의 치료가 필요한 상세불명의 손목 및 손의 표재성 손상 등을 입게 하였다.
