The costs of appeal are assessed against the defendant.

For the reasons indicated in its holding, the lower court determined that the instant money is the Plaintiff’s investment bond against the Defendant, and that there was an agreement between the Plaintiff and the Defendant to return the principal of the investment bond.

In light of the records, the fact-finding and judgment of the court below are justified. Contrary to the allegations in the grounds of appeal, there were no errors of violating the rules of logic and experience and exceeding the bounds of the principle of free evaluation

Therefore, the appeal is dismissed, and the costs of appeal are assessed against the losing party. It is so decided as per Disposition by the assent of all participating Justices on the bench.
