1. The defendant shall pay to the plaintiff 38,944,715 won with 20% per annum from July 12, 2016 to the day of complete payment.

Reasons

From February 18, 2013 to June 27, 2016, the Plaintiff was employed by the Defendant who runs the business of manufacturing and selling electronic parts and electronic materials, and retired from office. The fact that wages and retirement allowances not paid by the Defendant to the Plaintiff up to 38,94,715 won in total does not conflict between the parties, or that the amount of wages and retirement allowances not paid by the Defendant to the Plaintiff up to 38,94,715 won is recognized by each of the evidence Nos. 1 and 2. Thus, the Defendant is liable to pay to the Plaintiff delay damages at a rate of 20% per annum as prescribed by the Labor Standards Act from July 12, 2016 to the date of full payment.
