1. The Defendant shall calculate 50,5450,000 won to the Plaintiff as 15% per annum from May 22, 2017 to the date of full payment.
A claim indication: On August 2016, the Plaintiff completed the construction work by giving the number of copies to KRW 63,80,000,000 for the construction cost, from the Defendant’s August 2016. On the other hand, on January 2017, the Plaintiff supplied a design drawing by giving a number of copies to KRW 1.65,00,000 for the device design drawings of the watch-type mat.
Nevertheless, only KRW 10 million has been paid, and the remainder KRW 55,450,00 has not yet been paid.
A ground for recognition: A judgment based on a confession (Article 208(3)2 of the Civil Procedure Act, the defendant only submitted a formal objection after being served with the original copy of the payment order, and did not make a substantial answer despite the court's order for explanation preparation, and did not appear on the date for pleading. Thus, it is deemed that the plaintiff led to the confession of the plaintiff's assertion in accordance with Article 150(3) and (1) of the Civil Procedure Act.
