A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Punishment of the crime
The defendant is not a person handling narcotics.
1. Violation of the Act on the Control of Narcotics;
A. At around 22:00 on Apr. 1, 2017, the Defendant smoked marijuana once in a total of 13 times, as shown in the annexed crime list, in the residence of Seongdong-gu Seoul, Seongdong-gu, and the fourth-class rooftop, wherein approximately 0.5g of marijuana was smoked by attaching a smoke with a smoke of 0.5g to the rollerer. From that time, the Defendant smoked marijuana more than 13 times in total, as shown in the annexed crime list.
B. On June 21, 2019, the Defendant received marijuana: (a) around 21:10, the Defendant received and delivered approximately 0.5 grams of marijuana from E Station, cafeteria C, and F without compensation.
2. Violation of the Narcotics Control Act;
가. 피고인은 2019. 1. 20. 23:00경(한국시간) 호주 멜버른 이하 불상지에서, 음악파티장에서 만난 일명 ‘G’로부터 향정신정의약품인 MDMA(일명 ‘엑스터시’) 불상량이 희석된 칵테일을 건네받아 이를 마시는 방법으로 MDMA를 1회 투약하였다.
나. 피고인은 2019. 3. 29. 00:00경~05:00경 사이 서울 마포구 H 지하 ‘I’ 클럽에서, 성명불상자로부터 향정신성의약품인 MDMA 불상량이 희석된 칵테일을 건네받아 이를 마시는 방법으로 MDMA를 1회 투약하였다.
다. 피고인은 2019. 5. 5. 00:00경~05:00경 사이 서울 마포구 H 지하 ‘I’ 클럽에서, 성명불상자로부터 향정신성의약품인 MDMA 불상량이 희석된 칵테일을 건네받아 이를 마시는 방법으로 MDMA를 1회 투약하였다.
