1. The Defendant shall pay to the Plaintiff KRW 33,537,00 and interest rate of KRW 15% per annum from July 19, 2018 to the day of complete payment.

Reasons

Comprehensively taking account of the overall purport of the arguments as to Gap evidence Nos. 1 through 7, the plaintiff was awarded a subcontract for the floor-to-land and lebane waterproof construction from the defendant on March 20, 2018, among the construction works of the common residential facilities in Ansan-si, Ansan-si, the plaintiff completed the above construction works, but the defendant paid only KRW 42,00,000 out of the construction cost of KRW 75,537,000 (the defendant asserted that D, the head of the site office of the defendant, completed all settlement of the above construction works, but there is no evidence to acknowledge this). Accordingly, the defendant has the obligation to pay the plaintiff the interest for the construction cost of KRW 33,537,00 (75,537,000 - 42,000 - 42,000,000) and damages for delay calculated at the rate of 15% per annum from July 19, 2018.
