In full view of the circumstances that are disadvantageous to the Defendant, including the fact that the Defendant was punished for the same kind of crime, and that the amount of damage caused by the instant crime is considerable, or that the Defendant recognized and reflected the instant crime, that the Defendant agreed with the victim, that the Defendant was smoothly agreed with the victim, and other circumstances that form the conditions for the pleadings and the sentencing specified in the records, such as the character, conduct, environment, motive and means of the instant crime, and the consequences and results thereof, the sentence imposed by the lower court against the Defendant is deemed

Therefore, the prosecutor's assertion of unfair sentencing is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act as it is without merit. It is so decided as per Disposition.
