The prosecution of this case is dismissed.
Reasons
1. On April 25, 2017, the Defendant: (a) around 08:00, on the street of 10-0 Masan-ro, North-gu, Northern-ro, 885, for a change of 10-0 Masan-ro, with the victim C, and committed an assault to kill the breath from the damaged party; and (b) assault the victim’s breath by destroying the breath.
2. Article 260 (1) of the Criminal Act applicable to the facts charged for judgment: Judgment dismissing the prosecution by failing to prosecute the accused by attending as a witness at the fourth public trial date (Article 327 subparagraph 6 of the Criminal Procedure Act).
