갑 제1호증의 기재, 감정인 한국국토정보공사의 감정결과에 변론 전체의 취지를 더하여 보면, 원고는 충북 영동군 D 임야 23,355㎡(이하 ‘이 사건 임야’라 한다)의 소유자인 사실, 피고는 위 토지 중 별지 도면 표시 61, 60, 59, 58, 57, 56, 55, 54, 61의 각 점을 순차로 연결한 선내 ㈂ 부분 지상에 데크 4㎡를, 별지 도면 표시 53, 54, 55, 56, 19, 52, 53의 각 점을 순차로 연결한 선내 ㈄ 부분 지상에 건물 17㎡를, 별지 도면 표시 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, 40의 각 점을 순차로 연결한 선내 ㈅ 부분 지상에 데크 23㎡를, 별지 도면 표시 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, 45, 46, 47, 48, 49, 50, 51, 20, 21, 22, 24의 각 점을 순차로 연결한 선내 ㈆ 부분 지상에 구거 및 석축 248㎡를, 별지 도면 표시 35, 36, 37, 38, 62, 63, 35의 각 점을 순차로 연결한 선내 ㈇ 부분 지상에 가교 9㎡를, 별지 도면 표시 64, 65, 66, 67, 64의 각 점을 순차로 연결한 선내 ㈈ 부분 지상에 정자 13㎡를 설치하여 소유하고 있는 사실이 인정된다.
According to the above facts, the defendant is obligated to remove each of the above parts of the buildings, ditches, stone embankments, bridges, and sperm installed on the ground of the forest of this case.
Therefore, the plaintiff's claim is reasonable, and it is decided as per Disposition.
