No. 1 or 2 of the seized evidence shall be confiscated from the accused.

[2012 Highest 6099] The Defendant, who is not a narcotics handler, was prohibited from dealing with the psychotropic drug clocks (one-name clickphone; hereinafter “philopon”), but dealt with the philopon as follows.

1. A crime of selling philophones;

A. On June 25, 2012, at around 20:55, the Defendant received 80,000 won of philopon from the post office account (Account Number: F) in the name of G used by the Defendant, from the account in the name of G (Account Number: H). On the same day, at around 23:00, the Defendant sold a small plastic paper containing approximately 0.7 g of philopon to D on the street in front of the exit of the Gyeonggi-do Government No. 1, which was located at the 23:00 on the same day.

B. On June 26, 2012, around 17:38 and 17:50, the Defendant received KRW 2 million from D with the said method. At around 20:00 on the same day, the Defendant sold a small vinyl paper containing approximately five grams of philopon to D in the street around the restaurant located in the G of the Gyeonggi-si of the Gyeonggi-si.

C. On July 3, 2012, at around 22:59, the Defendant received 700,000 won from D with the said method. On July 4, 2012, around 00:30, the Defendant sold a small vinyl paper containing approximately 0.7 grams to D at the temporary domicile of D, which was located in the 1st century, in the 1st century, from the Government of Gyeonggi-si on July 4, 2012.

On July 8, 2012, the Defendant received 7.50,000 won from D with the above method, and sold a small vinyl paper containing approximately 0.7 grams to D from 24:00 on the same day.

E. On July 20, 2012, around 19:12, the Defendant received 7.50,000 won from D with the said method, and sold a small vinyl paper containing approximately 0.7 grams to D from 23:00 on the same day.
