1. The Defendant’s KRW 104,950,427 as well as the Plaintiff’s KRW 12% per annum from December 10, 2013 to August 31, 2015, and September 2015.

According to the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings (amended by Presidential Decree No. 29768, May 21, 2019), the statutory interest rate under the main sentence of Article 3(1) of the Act on Special Cases Concerning the Promotion, etc. of Legal Proceedings is 12% per annum from June 1, 2019. Thus, the portion of the claim for damages for delay seeking payment exceeding the rate of 12% per annum from December 18, 2019, the following day after the duplicate of the application for the instant payment order is served.
