1. The counterclaim of this case shall be dismissed.

2. An accident described in the attached Form against the Defendant (Counterclaim Plaintiff) by the Plaintiff (Counterclaim Defendant).

Reasons

1. Basic facts

A. On January 27, 2012, the Defendant was diagnosed on the following grounds: (a) due to the instant accident listed in the attached Form (hereinafter “instant accident”); (b) the Defendant suffered from the injury of the erode’s base and tension; (c) the left-hand shoulder strings; (d) the escape certificate of a acute sturatory signboard escape certificate (L4-5-S1); (c) the Defendant was diagnosed on the need for treatment for approximately four weeks due to the instant injury on February 4, 2012.

B. On July 11, 2012, the Plaintiff and the Defendant agreed that, instead of paying a sum of KRW 15,000,000 to the Defendant, Samsung Fire and Marine Insurance Co., Ltd., an insurance company of the Plaintiff and the Plaintiff, for damages based on the instant accident, the Defendant would not file a civil or criminal lawsuit related to the instant accident, or objection (hereinafter “instant agreement”).

C. The Plaintiff paid to the Defendant KRW 2,188,80 on March 6, 2012 as damages based on the instant accident, and KRW 10,744,80 on July 18, 2012. The Defendant paid KRW 2,06,400 on the aggregate of the medical expenses from February 27, 2012 to May 30, 2012 to the members who received treatment in relation to the instant injury. D. The Defendant paid KRW 2,06,40 on behalf of the Defendant on June 14, 2012.

In relation to the instant injury, the Defendant received from July 6, 2012 to March 11, 2013, 80 or more general hospital members on more than 80 occasions, and was hospitalized at C Hospital from February 1, 2013 to February 15, 2013.

E. At present, the defendant has a bridge, both bucks, paper bucks, and bucks, and there are pains of escape from the side of the conical signboard, the side of the conical signboard, and the side of the conical signboard (as indicated above, Nos. 4, 5, and No. 5, and No. 1, and No. 1, in total) and the vegetable root symptoms (hereinafter referred to as the "conical disability of this case").
