However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

The defendant is the professor of Busan University C.

A person who intends to conduct or participate in a national research and development project shall prepare a research and development plan stating the necessity for research and development, details of research and development expenses including personnel expenses, and apply for a research and development task to the head of the Korea Research Foundation. A person in charge of research shall not additionally pay personnel expenses to the researcher if he/she receives personnel expenses from the original institution.

Although the Defendant, in performing the national research and development projects registered as a person in charge of research and development, received unfair personnel expenses in violation of the above provisions and received them individually and voluntarily to use them. On April 2010, the Defendant, at the Busan National University Co., Ltd. located in the Geum-gu Busan National University, Busan National University No. 63-gil 2, 2010, voluntarily used personnel expenses, etc. paid to the researchers. However, as if the Defendant would lawfully pay personnel expenses to the researchers, he/she prepared an application for national research and development projects and plans, etc., and submitted them to the person in charge of the Busan National University, which keeps the research and development projects including personnel expenses, from June 18, 2010 to April 19, 2013, he/she acquired KRW 36,250,150 of personnel expenses of researchers related to “D” from the person in charge of the industry-academic cooperation foundation for Busan National University, and acquired them by deceptioning them from the total of KRW 150 to September 17, 2018, 2015.
