When any person intends to possess guns, swords, explosives, gas sprayers, electronic shock machines, or crossbows, he/she shall obtain permission from the head of a local police station having jurisdiction over his/her domicile in cases of guns, and from the head of a police station having jurisdiction over his/her domicile in cases of swords, explosives, gas sprayers, electroshock weapons, or crossbows, respectively, and obtain permission from the head of a police station having jurisdiction over his/her domicile in cases of guns, and shall obtain permission from the head of a police station having jurisdiction over his/her domicile in cases of guns, when he/she intends to possess shot gun, gas emission gun, air gun, butcher gun, industrial rescue gun, or parts thereof.

Nevertheless, from July 2007 to April 1, 2015, the Defendant possessed a 5.5m old air gun without obtaining permission from the head of the police station having jurisdiction over the domicile at the defendant's office located in Gangseo-gu Seoul Metropolitan Government C, and without obtaining permission from the head of the police station having jurisdiction over the domicile.
