Defendant shall be punished by a fine of 2.5 million won.
If the defendant fails to pay the above fine, 50,000 won shall be one day.
Punishment of the crime
The Defendant was a member of the election management commission of the Seo-gu Election Commission from around 2010 to March 6, 2012. D (preliminary candidate registration on December 13, 2011) that went out from the 19th National Assembly member election of the 19th National Assembly member that was implemented on April 11, 2012, was working as a research member of the E Research Institute established on September 20, 201, and 'F Emergency Countermeasures Committee (hereinafter referred to as "non-Subrogation") was established in the Seo-gu, Daegu-gu, which was used as a non-sanitary garbage landfill site in the 1980s, and is an organization formed by residents of the Republic of Korea on December 12, 2011.
No one shall distribute or spread documents, printed materials or other similar things indicating the name of a candidate, in which the contents of support, recommendation or opposition of a candidate (including a person who intends to become a candidate) are included, or the contents of such support, recommendation or opposition are indicated, in order to influence an election from 180 days before the election day to the election day.
Nevertheless, on January 1, 2012, in order to influence the election, such as enhancing the recognition map of preliminary candidate D for police officers and emphasizing local constituency activities, the Defendant: (a) published the phrases, such as the 11st day of April, 2012, such as the HD who was registered as the preliminary candidate in the Seo-gu area of the National Assembly member; (b) D’s photograph with a mother and child, and I’s photograph and the details of the E-Research Institute’s G-related activities established and operated by D in the name of “F Emergency Countermeasures Committee” (hereinafter “instant book”). (c) around that time, the Defendant made a publication in the name of the book (A4 pages 36), 2,557 copies (hereinafter “instant book”), and then distributed approximately KRW 390 copies to residents from G Gwon, a member of the said emergency Countermeasures Committee, in the name of “F Emergency Countermeasures Committee.”
Accordingly, the public official election law is enacted in order to influence the election.
