A. On August 5, 2012, Defendant B, at around 19:15, talked about the issue of street lamps A (n and 53 years old) and street lamps in the D market E located in the former North Korea-gun, and went to a trial, resulting in a scambling of body with the victim, and assaulted the victim’s left side by scambling.

B. Defendant A’s assaulted the victim’s body by setting up against the act of the victim’s B (n, 62 years of age), and breaking the victim’s body, and assaulted the victim’s chest once.

2. Determination is an offense falling under Article 260(1) of the Criminal Act and cannot be prosecuted against the victim’s express intent under Article 260(3) of the Criminal Act. The Defendants expressed their intent not to be punished on June 3, 2013, which was after the instant prosecution was instituted. Thus, all of the instant prosecutions are dismissed in accordance with Article 327 subparag. 6 of the Criminal Procedure Act.
