B is a person who participated in a special election for the president of the JAD on December 19, 2015, which was established for the redevelopment of housing units of the Suwon-gu Busan Metropolitan Government C members, and the defendant supports B.

The above union has the authority to decide on the election method by the election management committee, and in particular, the E, the chairman of the election management committee, if the number of votes is equal at the time of the resolution of the election management members.

Therefore, even though the Defendant was prohibited from offering money, valuables, entertainment or other property benefits, or indicating or promising to offer an intention to offer them, in relation to the election of union officers, the Defendant thought that he would offer money and valuables to E in a way that he would be able to adopt a voting method favorable to B election, such as selecting a multi-voting system desired by the Defendant and B, which is the chairman of the election management committee.

On November 20, 2015, the Defendant delivered a bag of 200,000 won in cash to E, who is the chairman of the election management committee, at G restaurant located in Suwon-gu, Busan, Busan, and requested E to decide the voting method as a multi-voting system.

As a result, the Defendant provided money and valuables to E in relation to the election of the president of the partnership.
