2. 특수협박 피고인은 위와 같은 날 16:20경 위 주택 앞 도로에서, 위 제1항 기재와 같이 피해자 B이 현관에서 밀어내는 바람에 집 안에 불을 놓지 못하게 되자, 왼손에 들고 있는 휘발유통을 들어 자신의 머리 위로 휘발유를 붓고 오른손에 라이터를 쥔 상태로 피해자 B에게 “어머니 이게 끝이 아닙니다.”라고 말하여 마치 자신의 신체에 불을 붙일 듯 한 태도를 보여 겁을 주었다.
