1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

Reasons

1. The summary of the plaintiff's assertion was a person holding the third class engineer's license and served as the head of the plaintiff company C.

피고는 2018. 11. 26.경 C를 운항하기 전 엔진오일, 엔진기관의 열을 식혀주는 장치인 청수펌프 등 기계장치에 이상이 없는지를 사전점검하고, 엔진시동을 걸고 난 이후에는 엔진이 제대로 작동하는지, 엔진오일에 누수가 없는지, 청수펌프가 제대로 작동되어 청수냉각수가 제대로 순환되어 배출되는지 등을 확인한 후에 출항하여야 하며, 또 출항 후 운행하는 동안에도 엔진오일, 청수펌프 등 기계장치 전반이 제대로 작동되고 있는지를 점검해야 할 주의의무가 있음에도 청수냉각수가 제대로 순환되지 않는 상태에서 C를 운항하여 엔진헤드 및 엔진헤드에 부착된 부품(씨트링, 벨브가이드, 노즐튜브 등)이 손상되는 사고(이하 ‘이 사건 1차 사고’라 한다)를 발생시켜 원고회사에게 합계 5,962,000원 상당의 손해를 입게 하였다.

2. The Plaintiff’s each of the instant accidents is the Defendant’s engineer with only the evidence presented by the Plaintiff.
