A. The relevant Plaintiff’s objective is the manufacture and sale of semiconductor parts, technical consultation and engineering related to biological processes, industrial plant construction, and design business. The Defendant is a company with the objective of manufacturing electronic components, manufacturing telecommunications equipment parts, and semiconductor equipment manufacturing business, etc. The Plaintiff’s representative director C was appointed as a inside director on the Defendant’s registry around February 2017 and served as the vice president on or around February 2017.

B. On April 10, 2017, the Plaintiff and the Defendant entered into an agency service contract between the original Defendant with respect to the production and supply of Lithium ion batteries production plant (F) in D or E (hereinafter “D, etc.”) with respect to the production and supply of the relevant Lithium ion batteries production plant (hereinafter “instant contract”).

C. The Plaintiff’s performance of the service and the Defendant’s payment (1) the Plaintiff received the Defendant’s order to manufacture and supply the F equipment ordered by D, etc. to the Defendant (hereinafter “instant service”).

(2) The Defendant shall include the amount of orders (i.e., KRW 58,00,00 on December 12, 2017 x 58,00 won on December 19, 2017 x 58,00,000 won on December 19, 2018 x 208,000 won on December 15, 2017 x 208,00 won on December 15, 2017 (i.e., KRW 19,530,000 on December 15, 2017 x 208,00 won on December 3, 2017 x 208,00 won on December 15, 2017 x KRW 10,530,00 on August 29, 2018; and (ii) KRW 408,00 on August 16, 2018.
