[1] The Fair Trade Act (hereinafter “Fair Trade Act”) provides that each person engaged in a construction business shall be subject to the Fair Trade Act.

(2) On October 1, 2009, the Korea Land Corporation and the Korea Land Corporation (the Plaintiff) integrated into the Korea Land and Housing Corporation (the Plaintiff). On January 9, 2009, the Plaintiff publicly announced the construction of public sewage treatment facilities and high-level sewage treatment facilities (hereinafter “instant construction”) through competitive bidding (hereinafter “instant bidding”) for the purpose of preventing water pollution in public waters and creating a pleasant living environment by treating sewage generated within the Incheon Free Economic Zone Cheongra International City development project district in accordance with the provisions of the Sewerage Act, including the Sewerage Act.

3) The instant tender is a package work for design and construction, and the procedure is comprised of the stages of “decision on a successful bidder (person eligible for a preliminary examination to submit a basic design) who is eligible for a prior examination to participate in a tender (to submit a basic design).” 4) A Scco Construction Co., Ltd. (hereinafter “Scco Construction”) (hereinafter “Scco Construction”) on January 1, 209 between Defendant Ccul Global and Defendant Culul Global, who will be eligible for a successful bidder in the instant tender, and Defendant Culul Global will participate in the instant construction.
