A. On September 15, 2004, the Defendant included the B miscellaneous land B, 126m2, C road 147m2, D large 329m2 (hereinafter “instant land”) and the two-story restaurant building on the instant land (hereinafter “instant building”) located within the development-restricted zone.

In order to purchase each obstacles listed in the table 3 through 8 in the table in paragraph (1) (hereinafter referred to as the "in this case obstacles") and complete the registration of ownership transfer on October 28, 2004.

B. On April 5, 2007, the Plaintiff publicly announced a compensation plan for the land to be incorporated into the said construction in accordance with the Act on Acquisition of and Compensation for Land, etc. for Public Works Projects, and A.

The land Nos. 1 and 2 of the following table among the lands listed in the port was divided into B miscellaneous land in Siung-si on April 3, 2007.

And the obstacles of this case were also included in the above construction work.

Accordingly, while acquiring each of the above land and the obstacles of this case from the defendant, the plaintiff prepared a written agreement (only the part related to this case) with the following contents:

1. Date and time of consultation: January 23, 2008;

2. Place for consultation: Si interest viewing (construction division).

3. Method of consultation: Individual consultation.

4. Details of consultation.

(a) accept the execution of the construction with respect to land and obstacles to be incorporated into E Road Packaging and receive compensation (176,385,000 won) after the transfer of ownership or the removal of obstacles;

(b) No right to use land, etc. after the receipt of an indemnity shall be claimed for all the rights, such as compensation for damages incurred by the execution of construction works, etc.;

(c) Removal of obstacles shall be borne by the project operator.
