1. All appeals filed by the Defendant (Counterclaim Plaintiff) against the instant principal lawsuit and counterclaim are dismissed.
2. The costs of appeal shall be the principal lawsuit.
1. Judgment on the main lawsuit
A. Facts of recognition 1) Seo-gu Seoul Seo-gu (hereinafter “instant tenement house”)
A) The apartment house is an aggregate building consisting of 18 households and one commercial building. D and E acquired 1/2 shares in the building of the instant apartment house from the Gwangju District Court on June 3, 1985 pursuant to the protocol of conciliation 85Hun-Ba62, and thereafter D acquired 1/2 shares in the building of the instant apartment house from E on July 28, 1987, and thereafter acquired 1/2 shares in the instant apartment house from E on February 8, 1988, and managed the instant apartment house by acquiring the right to land of the instant apartment house from February 8, 198. Thereafter, D died on September 3, 199, and the Plaintiff and F succeeded to 18 households in the instant apartment house from the instant apartment house to the Plaintiff and G, who are the heir of the deceased apartment house, the Defendant was sentenced to the above judgment from the date of closing argument to the date of the instant lawsuit on August 202, 200.
Meanwhile, on April 6, 2015, the instant tenement 202 had been registered for the transfer of ownership in the Defendant on April 6, 2015. However, while the Defendant had not completed the registration for the transfer of ownership with respect to the instant apartment house 202, the Plaintiff F, who was the Plaintiff, completed the registration for the transfer of ownership with respect to the said 202 on October 30, 2012 due to inheritance by agreement division. Accordingly, the Defendant filed a lawsuit against F, seeking the cancellation of the registration for transfer of ownership with the Gwangju District Court 2013Kadan1083, which was decided to recommend settlement on April 6, 2015, and completed the registration for the transfer of ownership with respect to the said F on April 6, 2015.
On March 23, 2016, due to the sale by compulsory auction, the ownership transfer registration has been made again in H in the future.
3 The instant tenement house is supplied with a single measuring instrument with the total water supply of multi-family housing, and is jointly used for other purposes.
