The defendant is a person operating Gwangju Mine-gu Co., Ltd., and from around 2008 to early 2019, the defendant was in a relationship with D with D, and D is an employee of the above company, who worked together with the defendant.

The defendant, around March 2019, failed to meet the operating funds of the company, had D lent money to the debtor or joint guarantor without the consent of D.

1. Crimes committed on March 12, 2019;

A. On March 12, 2019, the Defendant forged a private document by using a computer in the office of the Co., Ltd. located in Gwangju Mine-gu, Gwangju, prepared a certificate of loan stating that “The Defendant borrowed KRW 50 million from E to March 11, 2020, and D is legally liable for this loan,” and signed D’s name, resident registration number, and contact information on the joint guarantor column of the certificate of loan, and affixed D’s seal used by the said company on his name.

Accordingly, for the purpose of exercising authority, the Defendant forged a copy of the loan certificate in the name of D, a private document related to rights and obligations.

B. Around that time, the Defendant borrowed KRW 50 million from E with no knowledge that he was forged at E’s house located in Gwangju Mine-gu F, and offered the above forged D loan certificate to E.

Accordingly, the defendant exercised one copy of a forged D's borrowing certificate.

2. A person who forges, etc. a loan certificate to a police officer on March 2019.

A. On March 2019, the Defendant forged a private document by using a computer at the office of the Co., Ltd. located in Gwangju Mine-gu, Gwangju, the Defendant: (a) prepared a letter of loan stating that “D borrows KRW 50 million from E to March 11, 2020; and (b) the Defendant is legally liable for this loan; and (c) written D’s name, resident registration number, and contact information in the debtor column of the certificate of loan; and (d) used by the said company thereafter.
