(a) The facts subsequent to the facts of recognition may be found either in dispute between the parties or in full view of the respective entries in Gap evidence 1 and 2 and the purport of the entire pleadings.

1) The Defendant, Inc. (hereinafter “H”)

(2) In the process of managing ordinary business employees’ business activities, the Defendant received business allowances from the said company according to the business performance of the management employees, and at the time, received business allowances by directly lending another person’s name. (2) The Defendant was in a situation where, due to a low business performance and high interest short-term loan, the Defendant was in a situation where, around August 201, it was in fact not in excess of its obligation, and was using money as the borrowed money for the repayment of its existing debt.

3) On August 201, 201, the Defendant: (a) at the location of H branch offices and the private teaching institute, etc. of J’s operation located in Ansan-si, Sinsan-si; and (b) through K, etc., designated parties including Plaintiff (Appointed Party) (hereinafter “Plaintiffs”).

(4) On March 31, 2011 to August 19, 2016, the Plaintiff (Appointed Party) paid 2-8% interest per month to the H advertising sales business and returned the principal without a mold. However, the Defendant did not have any intent or ability to pay the principal and profit as agreed upon even if he/she received the money from the Plaintiffs because there is a very difficult economic situation at that time, and thus, the Defendant did not have any intent or ability to pay the principal and profit as agreed upon even if he/she received the money from the Plaintiffs. 4) The Plaintiff (Appointed Party) to the Defendant on March 31, 2011 to August 19, 2016, totaled KRW 33,291,000 won, KRW 587,000,000,000 won, KRW 587,000,000, KRW 4829,000,000 won, KRW 298,200,000.
