1.For the plaintiff: (a)
Defendant A Co., Ltd. shall provide for KRW 458,498,661 and KRW 157,188,413 among them.
1. Indication of the claim for judgment as to the claim against the defendant A corporation: as shown in the grounds of the claim in the attached Form;
Article 208 (3) 2 of the Civil Procedure Act)
2. Determination as to the claim against Defendant B, C, and D
A. There is no clear dispute between the Plaintiff and the said Defendants (hereinafter “Defendant”) regarding each of the facts stated in the attached Form of the judgment on the cause of the claim.
According to the above facts, the defendants are the inheritors of the deceased F (hereinafter referred to as the "the deceased") who are obligated to perform the deceased's obligations to the plaintiff according to their shares of inheritance, and the calculation thereof is as shown in the table in attached Form 3 above.
Therefore, the Defendants are obligated to pay to the Plaintiff the amount of damages for delay calculated at the rate of 18% per annum from April 11, 2006 to October 27, 2006, and 20% per annum from the next day to the day of full payment, according to the final judgment of the Seoul Central District Court 2006Gahap4193 as to each of the money indicated in the “principal debt” as stated in the “principal debt” of the said table, within the scope of the property inherited from the networkF as requested by the Plaintiff.
B. The Defendants alleged that they were subject to a qualified acceptance trial on the inheritance of the deceased, and seems to be unable to comply with the Plaintiff’s claim on this ground.
The fact that the Defendants reported the inheritance approval of the deceased and accepted the above report does not dispute the Plaintiff.
However, the qualified acceptance of inheritance is not limited to the existence of an obligation, but merely limited to the scope of liability, so long as the qualified acceptance of inheritance is recognized as the existence of an inherited obligation even in a case where the qualified acceptance of inheritance is recognized, the court shall render a judgment to fully perform the inherited obligation even if there is no inherited property or the inherited property is insufficient to repay the inherited obligation, except that the court shall render such judgment
