1. Of the judgment of the court of first instance, the part against the Defendants is revoked, and the Plaintiff’s claim corresponding to the revocation portion is respectively revoked.
1. Basic facts
A. From around 2003, E Co., Ltd. (hereinafter “E”) sold the third floor store of the building F and H in Gyeyang-gu, Seoyang-gu, Yangyang-si (hereinafter “instant building”).
B. On March 22, 2004, the Plaintiff concluded a sales contract with E on the third floor of the instant building No. 306 and No. 307.
분양계약서에는 ‘이 사건 건물 제3층 제306호의 용도가 스낵, 이 사건 건물 제3층 제307호의 용도가 아이스크림’으로 기재되었다.
Article 11 (1) of the contract for sale in lots states, "The designated store with the category of business shall not be converted to another type of business, and the responsibility for protection of E for the type of business shall be until the designated date of the sale in lots, and the management of the business after the sale in lots shall be governed by the management
On June 13, 2005, the Plaintiff completed the registration of ownership transfer relating to No. 306 and No. 307 of the third floor of the instant building.
다. 이 사건 건물 제4, 5, 6층에서 영화관을 운영하던 주식회사 I(E의 자회사, 이하 ‘I’이라 한다)은 2005년경부터 이 사건 건물 제3층인 별지 부동산목록 제1항 기재 건물 중 별지 도면 표시 1, 2, 3, 4, 1의 각 점을 차례로 연결한 선내 (가) 부분[이하에서 선내 (가) 부분을 구분하지 않고 ‘이 사건 건물 제3층 제317호’라 한다] 또는 별지 부동산목록 제2항 기재 건물(이하 ‘이 사건 건물 제3층 제316호’라 한다)에서 영화 관람객을 대상으로 팝콘, 음료수, 스낵을 판매하였다. 라.
On October 31, 2007, Defendant B purchased film museum buildings (the fourth, fifth, and sixth floor of the instant building) and third floor No. 317 of the instant building at I, and completed the registration of ownership transfer on November 8, 2007.
Defendant C, his father, was awarded the bid for No. 316 of the third floor of the building of this case through voluntary auction procedure, and paid in full the sale price on August 12, 2009, and completed the registration of ownership transfer in its name on the 27th day of the same month.
