1. Facts of recognition;
A. On July 24, 2012, the Plaintiff and the Selection E (hereinafter collectively referred to as “Plaintiff, etc.”) shall be deemed as “the instant land with a size not exceeding 380 square meters, namely, the Plaintiff, etc.” (hereinafter collectively referred to as “Plaintiff, etc.”)
(B) Each of 1/2 shares in the instant land is completed the registration of ownership transfer. D is a part of (a) in a ship, which connects each point of the attached appraisal No. 15, 16, 17, 18, 19, 20, 21, 22, and 15 on the ground of the instant land in sequence, and is a 36 square meters of a prefabricated tree board, a single house, etc. (hereinafter “instant building”).
C. On August 30, 2012, the Defendant entered into a lease agreement with D to lease the instant building with the lease deposit of KRW 10 million, and currently occupies the instant building. D. The Plaintiff and D occupation the instant building around 1990. On September 10, 1990, the Plaintiff had the right to purchase and dispose of KRW 34,90 square meters of the Fancheon-gun, Gancheon-gun, Inc. (hereinafter “Cansan”); however, D entered into a sales agreement with the Plaintiff to purchase the said Fan forest with KRW 330,000,000,000.
2) Since May 19, 1994, the above F forest was divided into G 31,679 square meters, H 3,230 square meters, G 3,230 square meters, and D, on January 24, 1995, newly prepared a sales contract with the Plaintiff on the above G forest and H land, and acquired the ownership of the above land on January 27, 1995. 3) The building of this case obtained a building permit of 20.3 square meters in Bluar Housing around 1960, and in the building ledger, F forest and land (land lot number was corrected from H 3,00 square meters in accordance with the registration conversion on May 19, 194) was located, but in fact, as seen above, the building of this case was located on the ground of this case.
4. On June 5, 1997, the Plaintiff completed the registration of ownership preservation for the instant building, and on the same day, D completed the registration of ownership transfer on the ground of sale on February 20, 1997.
