On May 4, 2015, at around 18:56, the Defendant: (a) reported a victim (the 20th beginning) who was unable to know who was suffering from short fats in the Hong-gu subway Station 165, Hong-dong, Mapo-gu, Seoul, the Hong-dong, the subway Station 165, and recorded a smartphone, which was in his possession, into the part of the victim, and then sealed the fats of the victim into the fat of the victim.

Accordingly, the defendant taken the body of the victim who could cause sexual humiliation or shame using smartphones with similar functions, against his will.

1. The sentence to be suspended under Article 59(1) of the Criminal Act: The reason for the suspended sentence of a fine not exceeding 2 million won is that the form of crime is relatively weak.

It seems that the defendant recognizes the crime and seriously reflects the attitude of the trial.

The defendant is the first offender, and is relatively 25 years of age.

The defendant has served in good faith for about two years at the present workplace, and social ties, such as family, are also clear.

In the future, the defendant has not been able to prevent recidivism and have a healthy life.

In addition to the above circumstances, when considering the conditions of sentencing as stipulated in Article 51 of the Criminal Act, namely, the age, character and conduct, intelligence and environment of the offender, relationship with the victim, motive, means and consequence of the crime, the defendant is remarkably dead, and thus, the sentence is suspended against the defendant.

A sexual crime subject to registration shall be considered to be registered.
