A defendant shall be punished by imprisonment for not more than ten months.

Reasons

Punishment of the crime

1. Preparation and holding of qualification certificates or private documents;

A. When the Defendant was urged to obtain a debt from the obligees, the Defendant prepared a false contract with the same content as the lease deposit, etc., and prepared a false contract with the same content as the lease of an apartment from B with the permission of B, and had the obligees display it to the creditors.

Therefore, at the D office of the Defendant’s operation of the E Licensed Real Estate Agent Office at the early December 2, 2016, the Defendant, without permission or delegation from the actual operator of the E Licensed Real Estate Agent Office, voluntarily downloaded through the Internet, entered the document form “multi-family lease contract” as “F apartment G, Dobong-gu Seoul Metropolitan Government, which is located using the Defendant’s computer,” “F apartment G, deposit money for lease, KRW 10 million, KRW 300,000,000, monthly, and the contract term “from December 18, 2016 to December 17, 2018,” “B,” “B, lessee,” and broker’s representative of the E Licensed Real Estate Agent Office,” and affixed H’s seal on the name side of H’s arbitrarily recorded without permission, notwithstanding the fact that H is not the representative of the E Licensed Real Estate Agent Office.

Accordingly, for the purpose of exercising, the defendant prepared one copy of the apartment lease contract, which is a private document on rights and obligations, by gathering the qualification of the representative of the E Licensed Real Estate Agent Office.

B. While the Defendant leased a camping site to I, the Defendant was urged to return the lease deposit due to the rescission of the contract, he had the intention of deceiving I as if he had sufficient ability to pay the deposit by presenting the false lease contract with B prepared as in the preceding paragraph.

Therefore, the defendant, through a mobile phone text message around May 24, 2017, completed a photograph file of the apartment lease contract, which was prepared by I, who is unaware of the fact, with the qualification of the representative of the E Licensed Real Estate Agent Office, as in the preceding paragraph.
