A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

To the extent that there is no risk of actual disadvantage to the defendant's exercise of the right of defense, part of the facts charged was appropriately revised.

The defendant committed a fire-fighting crime on the ground that it is difficult to live because of lack of a certain residence and occupation, and tried to voluntarily surrenders to investigation agencies to the prison and receive it from the prison.

1. 2. However, the fire officers dispatched upon receipt of the report did not have the intent to extinguish the fire prior to the removal of the fire from the building.

Thus, the defendant was trying to fire a structure by setting fire, and the defendant was attempted to commit the crime.

3. At around 03:45 on the same day, the Defendant continued to commit attempted fire to a general structure and fire on the same day before the “L” building operated by K located in the Dong-gu Incheon Metropolitan City on the same day. However, even though the Defendant attempted to extinguish the above building and the hospital building operated by the M of the above building by attaching the string to the strings, the fire officers in receipt of the report failed to extinguish the fire before moving the string to the above building.

Therefore, the defendant was trying to fire a structure by setting fire, and the defendant attempted to commit the crime.
