A defendant shall be punished by imprisonment for not less than eight months.
Punishment of the crime
1. An employer in violation of the Labor Standards Act shall, if a worker retires, pay the wages, compensations, and other money or valuables within fourteen days after the cause for such payment occurred;
The Defendant, under the trade name B B 2Ma 202, Inc., employs ten full-time workers, and operates the Aluminum manufacturing business, and even if D retired from office from office from August 25, 2005 to July 12, 2013, the Defendant did not extend the date of payment of KRW 80,000 for March 25, 2013, for April 2013, 2013, for which 2,650,000 for wages, and KRW 2,60,000 for May 2, 2013, 200 for wages of KRW 2,850,00 for June 2, 2013, and wage of KRW 1,219,960 for total 10,1960 for 14 days without an agreement between the parties concerned.
In addition, the Defendant did not pay the total amount of KRW 56,010,296 to workers on nine occasions in total, as set out in the [Attachment 1-9] No. 1-9, in the absence of an agreement between the parties concerned, within 14 days from the time when the cause for payment occurred.
2. An employer who violates the Guarantee of Workers' Retirement Benefits Act shall, in case where a worker retires, pay the retirement allowance within fourteen days after any cause for such payment occurred; and
The defendant employed 10 full-time workers at the place specified in paragraph (1) above as C (main) and operated a shower manufacturing industry at Aluminum, and even when D retired from office from office from August 25, 2005 to July 12, 2013, the defendant did not pay 8,838,819 won of retirement pay within 14 days from the date of retirement by an agreement between the parties.
In addition, the Defendant did not pay the employees a total of KRW 36,352,501 of retirement allowances within 14 days from the time when the cause for the payment occurred, as set out in the [Attachment Table Nos. 1, 5-10] Nos. 1, 5-10.
