Punishment of the crime

1. Defendant A’s crime;

A. (1) On December 7, 2016, the Defendant driven a F K5 vehicle while under the influence of alcohol content of 0.250% at the section of approximately 100 meters near the E-Road in the following city around 22:10 on December 7, 2016.

(2) On July 13, 2016, the Defendant was issued a summary order of KRW 1 million for a crime of violating road traffic law in the Gunsan Branch of the Jeonju District Court for the violation of the Road Traffic Act, and was found to have been driving a motor vehicle while under the influence of alcohol on the day specified in Article 1-A(1).

On April 30, 2017, the Defendant driven a F K5 vehicle while under the influence of alcohol with approximately 0.214% alcohol concentration in blood at the section of approximately 500 meters near H company located in the Hasan-si G on April 30, 2017.

Accordingly, the Defendant, who violated the prohibition of driving under the influence of alcohol not less than twice, was driving a motor vehicle under the influence of alcohol again.

나. 범인도 피교사 피고인은 2016. 12. 11. 경 익산시 갈산동에 있던 구 익산경찰서 사거리 부근에 주차한 F K5 차 안에서 대리기사인 B에게 “ 음주 운전 단속 지점까지 대리 운전을 하다가 도로가 좁은 초행길이고 깜깜 하여 잘못 운전하여 바퀴를 농로 쪽으로 빠뜨린 것으로 진술해 달라.” 고 부탁하여 B로 하여금 제 1의 가의 (1) 항 일 시경 피고인이 음주 운전을 한 사실이 없다는 취지로 허위 진술할 것을 마음먹게 하였다.
