The prosecution of this case is dismissed.

1. The Defendant is a foreigner of Kazakh’s nationality.

1. Any person who violates the Automobile Management Act shall file an application for the registration of transfer of ownership of a motor vehicle with the Mayor/Do Governor within 15 days;

Nevertheless, even though the Defendant acquired the said car from the owner of the niversized vehicle B at the nives of Jun. 10, 2016, the Defendant did not apply for the registration of ownership transfer in the name of the Defendant within 15 days without justifiable grounds.

On July 23, 2016, the Defendant was driving a motor vehicle with detached motor vehicle without obtaining a driver’s license from approximately 16 km section from the front day of the area in the Mancheon-si, Mancheon-si, Macheon-si, to the front side of the area in the Mancheon-si, Mancheon-si, to the front side of the area in which the wife population is located, and from the 16 km section without obtaining a driver’s license.

2. Determination

A. In accordance with Article 248 of the Criminal Procedure Act, a public prosecution does not take effect on other persons than the defendant designated by the public prosecutor as the defendant. Thus, the prosecution takes effect only on those designated by the public prosecutor as the defendant. Thus, even if the defendant was indicated as the defendant due to the fact that other persons' names are copied, this is merely an error in the indication of the party, and the public prosecutor instituted a public prosecution against the defendant. Thus, it cannot be said that the mother becomes the defendant and the victim's identity has the effect of the public prosecution.

Therefore, in such a case, the prosecutor must correct the identification of the defendant by correcting the personal information of the chief of the public prosecution, and this is the defendant.
